BIOGRAPHY
David J. Malley is a partner with the Firm, focusing his practice on complex business and commercial litigation. David is rated AV Preeminent® by Martindale-Hubbell® and was named Best of the Bar by the Las Vegas Business Press in 2011.
Originally from Metro Detroit, Michigan, David obtained his B.A. from the University of Arizona in 1999 and graduated from the J. David Rosenberg College of Law at the University of Kentucky in 2002. During law school, David was a member of the Trial Advocacy Board and the Journal of Natural Resources and Environmental Law.
David was a partner at Jolley Urga Woodbury & Holthus prior to joining Hutchison & Steffen in December 2023. In his free time, David enjoys spending time with his wife and two children, finding things to fix around the house, and watching the Vegas Golden Knights.

REPRESENTATIVE ENGAGEMENTS:
- Involved in successful representation of a client in a complex and wide-ranging multi-billion-dollar lawsuit involving corporate governance, fiduciary duty, and share redemption claims.
- Obtained dismissal at pleading stage of a lawsuit brought under the Lanham Act claiming false designation of origin of gaming hardware and software.
- Obtained a seven-figure jury verdict on behalf of a consumer after a business wrongfully failed to remove derogatory information from the consumer’s credit report.
- Secured summary judgment in excess of $1,000,000 on behalf of a defrauded investor.
- Awarded summary judgment as the initial response to a lawsuit brought by a vendor seeking to improperly enforce a contractual automatic renewal provision.
- Participated in trial and settlement negotiations resulting in favorable settlement on behalf of real estate sellers sued for specific performance of a purchase and sale agreement.
- Obtained summary judgment on a slander of title claim against a real estate broker who wrongfully recorded a lien against real property for a commission that was not owed.
- Successfully defended businesses sued by a competitor alleging unfair competition.
- Represented investors to maximize their recovery in the first Receivership of a licensed cannabis company in Nevada.
- Granted preliminary injunctive relief enforcing a non-compete agreement on behalf of an employer against its former employee.
- Successfully defended employers in suits alleging they assisted newly hired employees in breaching their non-solicitation agreements with their former employers.
- Counseled businesses on protecting their competitive advantage, confidential information, trade secrets, and goodwill.
